INTRODUCTION 
  
This website was created by the Home Purchase Deposit Creditors Deposit Holders Committee of Creditors Holding Unsecured Claims, the "Deposit Holders Committee" and pursuant to that Court Order Granting Joint Home Purchase Deposit Creditors Deposit Holders Committee of Creditors Holding Unsecured Claims Application to Employ Dux Marketing, dated February 26, 2008.  The Deposit Holders Committee was formed by the Office of the United States Trustee, pursuant to 11 U.S.C. §1102.  The Depositors Committee is comprised of seven (7) individuals who have themselves paid deposits to the pre-petition Debtors for the construction of homes.
 
The Depositors Committee is intended to be an advocate for the interests of "Deposit Holders;" that is, the claims of those individuals who: (i) currently are parties to contracts with one of the Debtor entities for the purchase of a home and have posted a deposit for the purchase of that home; and (ii) individuals whose purchase contracts have been rejected, and who now hold claims for rejection damages, including but not limited to a claim for the deposit paid.  Deposit Holders must understand that the Depositors Committee does not represent the individual interest of any single Depositor.  While the Depositors Committee has retained the services of Ehrenstein Charbonneau Calderin (“ECC”) as its counsel, Depositors should also understand that ECC cannot provide legal advice to individual Depositors.
 
This website is intended to be a resource for Depositors.  We have provided links to the websites of Soneet Kapila, the Chief Administrator for those Debtor entities where Wachovia is the secured lender, and Andrew Bolnick, the state court receiver for those Debtors where Bank of America is the secured lender.  If you have contracted to purchase a home in a Levitt community where either Wachovia or Bank of America is the secured lender and you are interested in pursuing closing on your home you should contact either Messrs. Kapila or Bolnick directly. 

There are over 600 Depositors.  Because of the volume of calls received at our offices, we ask that you first navigate this website in an effort to have your questions answered.
